GENERAL TERMS AND CONDITIONS OF SALE AND PARTICIPATION
PAUSE is a project and a trade name developed and operated by MLG SOLUTIONS, a single-member limited liability company (SARL), registered with the Bobigny Trade and Companies Register under number 921 656 567, whose registered office is located at 34 avenue Aristide Briand, 93160 Noisy-le-Grand, France (hereinafter referred to as the “Provider” or the “Organizer”).
These General Terms and Conditions of Sale and Participation (hereinafter the “GTC”) form part of the legal framework of MLG SOLUTIONS.
1. Purpose and scope
These General Terms and Conditions of Sale and Participation govern all services offered by MLG SOLUTIONS within the framework of the PAUSE project, including in particular:
-
experiences and stays with fixed dates (weekends, weeks, retreats);
-
membership to the PAUSE community;
-
events and one-off experiences.
These GTC apply, without restriction or reservation, to any participant, client or member (hereinafter the “Participant”).
Any registration, booking or membership implies full and unconditional acceptance of these GTC.
2. Nature of PAUSE experiences
The experiences offered by PAUSE are designed to provide a supportive environment for rest, inspiration, overall well-being and meaningful exchanges.
Participants acknowledge that:
-
the effects and benefits of the experiences are subjective and may vary from one person to another;
-
no guarantee of physical, mental, emotional or professional results is provided.
The services offered do not constitute medical, therapeutic, psychological or paramedical services.
3. Booking conditions
A booking becomes firm and final:
-
upon validation of the online registration; or
-
upon written confirmation by the Organizer,
and after payment of the first amount due, as specified at the time of booking.
The Organizer reserves the right to refuse any registration without having to justify its decision.
4. Prices and payment terms
Prices for experiences, stays and memberships are indicated in euros, all taxes included.
Payment terms (single payment or instalments) are specified at the time of booking or membership.
Unless otherwise stated:
-
any instalment payment constitutes a firm commitment;
-
failure to pay an instalment may result in suspension or cancellation of participation, without refund of sums already paid.
5. Cancellation – postponement – interruption
Cancellation, postponement and refund conditions are specified on the page of each experience or in the information provided at the time of registration.
Unless otherwise stated:
-
any cancellation by the Participant does not give rise to any refund;
-
any early departure or voluntary interruption of the experience shall not give rise to any refund, whether total or partial.
When the Organizer is forced to cancel an experience (in particular in the event of an insufficient number of participants), the sums paid will be refunded within a reasonable period.
6. Participant responsibility – health
Each Participant acknowledges and accepts that:
-
participation is under their personal responsibility;
-
it is their responsibility to assess their physical and mental ability to take part in the activities offered;
-
they are responsible for informing the Organizer of any specific medical condition.
The experiences may include gentle or more intense physical activities, as well as body-based or well-being practices.
Participation of pregnant persons is under their sole responsibility and must be reported to the Organizer in advance.
7. Limitation of liability
The Organizer shall not be held liable in particular for:
-
the Participant’s state of health before, during or after the experience;
-
injuries, accidents, discomfort or physical or emotional reactions;
-
personal decisions taken by the Participant during or after the experience.
In any event, the Organizer’s liability is strictly limited to the amount actually paid by the Participant.
8. Activities outside the programme and third parties
Activities carried out outside the official programme are the sole responsibility of the Participant.
The Organizer is not responsible for services provided by third parties (accommodation, transport, catering, local service providers, etc.). Any claim must be addressed directly to the service provider concerned.
9. Insurance and travel
The experiences offered by PAUSE do not constitute package travel within the meaning of applicable regulations.
Each Participant is responsible for:
-
organising their own transport;
-
holding valid travel documents;
-
taking out personal insurance covering the activities undertaken.
10. Conduct and exclusion
The Organizer reserves the right to exclude any Participant whose behaviour is inappropriate, dangerous or contrary to the values of respect and safety of the group.
No refund may be claimed in the event of exclusion.
11. Image rights – photos and videos
Unless expressly objected to prior to the start of the experience, the Participant authorises the Organizer to use images, photos or videos taken during the experiences for communication purposes.
12. Personal data
Personal data collected are used exclusively for the organisation of PAUSE experiences and are processed in accordance with applicable data protection regulations.
13. Force majeure
The Organizer shall not be held liable in the event of non-performance or modification of the services resulting from an event of force majeure.
14. Governing law and jurisdiction
These General Terms and Conditions of Sale and Participation are governed by French law.
In the event of a dispute relating to their validity, interpretation, performance or termination, the parties shall endeavour to find an amicable solution before any legal action.
Failing amicable agreement, the competent courts shall be those within the jurisdiction of Bobigny, notwithstanding multiple defendants or third-party claims.
15. Specific conditions – partnerships with sports coaches
For certain experiences or retreats organised in Paris or in France, PAUSE may collaborate with sports coaches or partner facilitators under a co-creation model.
The financial, operational and organisational terms applicable to such partnerships (in particular revenue sharing, deposits, expenses or respective responsibilities) are governed by specific agreements concluded directly between MLG SOLUTIONS and the coaches concerned.
These specific agreements shall prevail over these GTC for all matters relating to the relationship between MLG SOLUTIONS and the partner coaches and are not enforceable against the end participants of the experiences.
